Subject:  ECS - Amended List of Undertakings Exempt from Cultural Resources Reviews in Maine

Purpose.   To replace the list of NRCS Undertakings that are exempt from cultural resources reviews in Maine.

Expiration Date.  September 30, 2013.

Background.  NRCS Maine’s State Level Agreement with the Maine Historic Preservation Commission (SHPO) and Consultation Protocols with the Passamaquoddy Tribe and Penobscot Indian Nation each include a list of NRCS undertakings that are exempt from cultural resources reviews in Maine.  This common list is included in the FOTG under Section II/Cultural Resources Information/Cultural Resources Reviews.  Due to changes in conservation practices offered in Maine and to the desire to exempt certain practices from reviews of architectural properties, it was necessary to amend the list. 

Explanation.  Consultation with SHPO, the Passamaquoddy and Penobscot Tribal Historic Preservation Officers led to an amended list of NRCS undertakings, which are exempt from cultural resources reviews in Maine (see attachment).  

Note that conservation practices on the new list are divided into two groups:

1)  “Conservation Practices” – These practices are exempt for both archaeological and architectural properties.

2)  “Conservation Practices:  Exemptions ONLY for architectural properties (archaeological reviews still required).”  - These practices are exempt solely from architectural reviews; archaeological reviews remain necessary. 

Note:  When all undertakings on a given ME-CR-1 worksheet are exempt from an architectural review, planners are to leave Question 4 (Architectural Resources) blank.
