Subject: CPA – Wetland Conservation Compliance

Purpose. To provide clarification to Natural Resources Conservation Service (NRCS) and Farm Service Agency (FSA) and NRCS’ responsibilities for conducting certified wetland determinations and use of the revised Form AD-1026.

Expiration Date. September 30, 2011

Background. In recent years, several policy changes and clarifications have been made to the Wetland Conservation Compliance provisions of the Food Security Act of 1985 that have implications when NRCS is required to conduct certified wetland determinations. These policy changes have been incorporated into the National Food Security Act Manual (NFSAM) through Circulars No. 1, 2, 3 and 4. On April 20, 2006, FSA issued a revised Form AD-1026, which contains several changes designed to improve NRCS administration of the Highly Erodible Land Conservation (HELC) and Wetland Conservation (WC) “Memorandum to the Field”. Similar guidance was given in FSA Handbook 6-CP, Par. 456. While these National Bulletins have expired, the guidance in FSA Handbook 6-CP, Par 456 is still current. NRCS and FSA must be familiar with these changes as they affect when NRCS is required to conduct certified wetland determinations for Food Security Act purposes.
