Subject: CPA - Canada lynx Consultation Reporting Requirements for Fiscal Year 2010

Action Due: August 27, 2010

Purpose. To announce the need to prepare an annual report on field office use of the Canada lynx Practice Effects Matrix.

Expiration Date. September 30, 2010

Background. During FY2009, a matrix was developed to assist NRCS planners to make an Endangered Species Act (ESA) Determination on effects of NRCS conservation practices on the federally threatened Canada lynx. The matrix was also developed to streamline and expedite interagency section 7 consultations required by the ESA.

Explanation. The United States Fish and Wildlife Service (USFWS) requires NRCS to prepare and submit an annual report on the number of “Not Likely to Adversely Affect (NLAA) lynx” determinations made by NRCS according to guidance in the practice effects matrix developed for the lynx. The report will satisfy mandatory interagency consultation reporting requirements of the ESA, and will also help document time savings accrued by both agencies from use of the matrix.

1. Each field office within the range of Canada lynx will document the number of NLAA  
    lynx determinations made from September 1, 2009 through August 27, 2010 on the
    attached spreadsheet and provide an electronic copy of their spreadsheet to Jeff
    Norment, Biologist by COB on August 27, 2010.
2. The State Office will submit a compiled spreadsheet to USFWS by COB on August 27,
    2010.
