Subject: PGM - Guidance on AGI Program Eligibility Information and Collection of Payments for 2009, 2010, and 2011 Program Contracts
Purpose: To provide instructions on collection of AGI information for 2009, 2010, and 2011 program participants that were determined “Not Met COC,” “Not Met Producer,” “Compliant Producer,” and “Not Filed” by FSA and have been determined as “Administratively Final Determinations.”

There are 225 conservation program contracts in Alabama where the participant did not file necessary paper work with FSA for AGI verification with the Internal Revenue Service. We have been tasked with helping collect this information. A list of contracts per county has been provided to all applicable counties via email. The DC is to visit each participant on their list and obtain the following information:
A CCC-931 signed by the participant with the appropriate year checked that they had a contract with NRCS (2009, 2010, and/or 2011).
A written statement from the participant stating why they did not originally file a CCC-931 with FSA and why they would like for FSA to re-open their case and consider re-evaluation of the CCC-931. It must be signed and dated by participant.
Once the DC has received these two documents, they should write out a brief statement of any history they have on the case (related only to AGI verification). Please include why you would recommend that this case be re-opened for the participant and why it would be harmful to the agency if it was not re-considered. Please provide these three documents to FSA. Please have the FSA employee initial that they have received the three documents and keep a copy for your file.
